HARMAN International Industries, Inc. and its affiliates and subsidiaries (“HARMAN" or the “Company") value your privacy and are committed to protecting your Personal Information. This Privacy Notice explains how we process and protect the Personal Information that we collect about you when you use our products and solutions, use a HARMAN website or application from which you are accessing this Privacy Notice (a “Site" or “Sites"), provide services to HARMAN as an agent, employee, or contractor of another company that does business with HARMAN, or otherwise interact with the Company.
Depending on your relationship with us, you may receive a separate privacy notice that applies to Personal Information we collect in specific circumstances, such as if you participate in testing one of our products. Personal Information We Collect and Our Sources
In this Privacy Notice, “Personal Information" means information that identifies, relates to, describes, or can be linked to you. The types of Personal Information we collect depends on how you interact with us and may include the following:
- Identifiers: Including your name; address; email address; telephone number; unique online identifier; Internet Protocol address (“IP address"); and account name.
- Customer Records: Including usernames and passwords; date of birth; payment information; sleep and health data (if using a sleep/health related product); and product reviews and warranty information.
- Commercial Information: Including the names and descriptions of the products purchased; the place(s) of purchase; and the price paid for the product(s).
- Biometric Information: Including voice recordings, from which an identifier template, such as a voiceprint, can be extracted; and fingerprint data.
- Internet or Other Electronic Network Activity Information: Including pages visited on a HARMAN Site and links clicked; language preference; and interactions with ads.
- Geolocation Information: Including geolocation information collected when you use certain of our services.
- Sensory Information: Including auditory, visual, thermal, or similar information that can be linked to or associated with you.
- Professional or Employment Information: Including employer; job title; certificates/degrees earned; and other information obtained as a business contact of HARMAN.
- Inferences: Which are drawn from the information described above (except information considered sensitive) to create a profile that reflects your interests, preferences, characteristics, trends, and behavior.
Certain information described above may be considered Sensitive Personal Information, including certain financial account numbers, biometric information, neural data, health information, and precise geolocation.
We collect Personal Information from the following sources:
- Directly From You. HARMAN may collect Personal Information from you when you use our websites, apps, products, or automotive solutions, register your HARMAN product, interact with the Company at a trade show, conference, or other in-person event, or otherwise contact or connect with the Company, including via phone, email, or through social media. We may also collect information from you when you interact with HARMAN as an agent, employee, or contractor of another company that does business with HARMAN.
- Cookie and Other Automated Technology. We collect information through technologies such as cookies to enhance our ability to serve you and to improve our business. When you access and use a Site, HARMAN and, in some cases, other third parties, collect information about how you interact with a Site. - From Third Parties. We may also collect information about you from a third party, including:
- Service Providers, Vendors, and Distributors: Including our website payment processor, companies that we work with to service and sell our products, and the organizers of our conferences and trade show events.
- Your Employer: Such as when you are an agent, employee, or contractor of another company that does business with HARMAN.
- Original Equipment Manufacturers (“OEMs"): Companies that use our products within their vehicles.
- Publicly or Commercially Available: Sometimes we collect publicly or commercially available information, including information from the social networks you use, and combine this with other information about you.
- Other Third-Party Sources: Including our business customers and partners, your friends and family (if, for example, we offer a referral program), device manufacturers, and others from which you direct us to collect your information.
Why We Collect and Use Your Personal Information
HARMAN may collect and use each category of your Personal Information listed above for the following purposes:
- Providing Our Services: Including managing accounts, fulfilling orders, running promotions and events, registering products, delivering and personalizing products and services you request, providing customer service and technical support, and responding to questions and feedback.
- Marketing and Advertising: Including through email newsletters, digital advertising, surveys and promotions, promotional mailings, and text messaging.
- Conducting Research: Including market research and analysis and internal research for technological development.
- Improving our Services: Including evaluating and improving the online user experience and soliciting and responding to feedback.
- For Compliance Purposes: Such as helping us comply with the law or to protect the rights, property, or safety of HARMAN, our users, or others.
- Managing our Supplier, Vendor, and Partner Relationships: Including managing HARMAN's relationship with you in your role as an agent, employee or contractor of another company that does business with HARMAN.
- For Internal Business Purposes: Including for our day-to-day operations, maintaining business records, reporting, and auditing activities; maintaining network and information security, verifying identity, and preventing fraud; permitting access to our systems and facilities; and reporting suspected criminal acts.
HARMAN sometimes uses Personal Information for profiling. For example, HARMAN may display advertisements and send emails to you containing content automatically chosen based on the products you have ordered from us in the past.
We use Sensitive Personal Information only as necessary to perform the services you request or to provide the goods the average person would reasonably expect when requesting those goods or services; to ensure security and integrity; for short-term transient use; to maintain the quality of our products and services; or for other purposes permitted by applicable law. We do not use Sensitive Personal Information for profiling or to infer characteristics about you.
Our Legal Basis for Processing
When required by law, HARMAN identifies a legal basis for processing your Personal Information, which may include the following:
- With Your Consent: If you have given consent to the processing of your Personal Information for one or more specific purposes. This may include when we process your Sensitive Personal Information for research purposes or request to process your Personal Information for an additional purpose.
- As Necessary to Comply with a Legal Obligation: When we are required to process your Personal Information for compliance with a legal obligation to which HARMAN is subject, such as regulatory reporting and retention requirements.
- As Necessary for the Performance of a Contract: For example, when processing your orders and payments or providing services to you—and to take steps, at your request, before entering into a contract with you. We may also process your Personal Information pursuant to a contract with a company with which HARMAN does business and for which you act as an agent, employee, or contractor.
- As Necessary for our Legitimate Interests: When such interests are not overridden by your interests or your fundamental rights and freedoms. Our interests may include:
- Relationship management: We have a legitimate interest in servicing and improving our relationship with you and/or the company you work for.
- Marketing and advertising: We have a legitimate interest in sharing with you information about products and services that you have ordered or that we think you might be interested in. Unless you opt out as described below, we rely on our legitimate interests to communicate with you about those products and services.
- Network and information security, fraud prevention, and reporting suspected criminal acts: In the event of fraud, a security incident, or a suspected criminal act, we would examine Personal Information that appeared to be linked to the incident as necessary to determine what happened, remediate, report to the authorities, and prevent a recurrence.
When We Disclose Your Personal Information
We generally disclose your Personal Information to further our business purposes, to fulfill your requests, or as may be disclosed to you at the time of collection. Some of the ways we may disclose your Personal Information include:
- Service Providers: We will disclose your Personal Information to service providers that help us provide our services. The following are some examples of the types of service providers we use:
- Data Analytics: We retain service providers to help us perform data analytics, including analytics regarding your interactions with our Sites, purchases you make, and general interactions with our services
- Payment Processors and Order Fulfillment: We use third-party order and payment processors when you purchase products from us or contact our local service providers in certain countries.
- Marketing: We may disclose your Personal Information to vendors who help us create and send marketing and promotional emails, maintain our suppression lists, and track the effectiveness of our marketing campaigns. We also use third-party service providers to organize HARMAN conferences and trade shows.
It is our practice to require service providers to protect your Personal Information and not use it for purposes other than to provide services to us.
- Advertising Platforms: We may disclose Personal Information to advertising networks and platforms so that they can show you HARMAN advertisements on other websites and apps. These services can help us tailor advertising that we think may be of interest to you based on your interactions with us.
- Required Disclosures: We may be required to disclose Personal Information in a court proceeding; in response to a court order, subpoena, civil discovery request, or other legal process; or as otherwise required by law.
- Legal Compliance and Protections: We may disclose your Personal Information when we believe disclosure is necessary to comply with the law or to protect the rights, property, or safety of HARMAN, our users, or others. This includes exchanging Personal Information with other companies and organizations for fraud protection and credit risk reduction, and to obtain legal or similar professional advice.
- Corporate Transactions: We reserve the right to disclose and transfer your Personal Information:
- In connection with a corporate merger, consolidation, bankruptcy, the sale of substantially all of our membership interests and/or assets, or other corporate change, including to any prospective purchasers.
- To a subsequent owner, co-owner, or operator of a Site or service or a successor database.
We may also disclose your Personal Information to affiliates and subsidiaries of HARMAN, including across business units, to coordinate our operations, streamline the services we provide, and for other internal business purposes.
How We Protect Your Personal Information
The security and confidentiality of your Personal Information is important to us. We have technical, administrative, and physical security measures in place to protect your Personal Information from unauthorized access or disclosure and improper use.
For example, we use industry standard encryption to protect certain data collection on our Sites. In addition, we have in place access controls, data loss prevention policies, and other security procedures that are designed to protect Personal Information from misuse, loss, and other unauthorized activities.
Please note that despite our reasonable efforts, no security measure is ever perfect or impenetrable, so we cannot guarantee the security of your Personal Information. It is important for you to also take measures to protect your information and the devices you use. For example, be sure to close your browser after you have completed your visit to a Site.
How Long We Keep Your Personal Information
HARMAN will retain your Personal Information for the time period needed to accomplish the purpose for which HARMAN collected it, and for as long thereafter as is permitted or required by applicable law. Your Rights and Choices
Your Account: If you have an account with HARMAN, you may have access to certain rights and choices from your account. Please log in to your account to view these options.
Unsubscribing From Emails: You may cancel or modify the email communications you have chosen to receive from HARMAN by following the instructions contained in emails from us. Alternatively, you may email HARMAN at unsubscribe@harman.com with your request, stating 'Unsubscribe' in the header and what email addresses you wish not to receive HARMAN emails. Within a reasonable period, we will take steps to unsubscribe each email address listed.
Unsubscribing From Text Messages: If you receive text message from us, you may opt out at any time by texting STOP in response to any text message.
Privacy Rights: Depending on where you live, you may have rights to access, correct/complete, delete/erase, restrict the processing of, or obtain copies of your Personal Information. You may also have rights to request anonymity and withdraw your consent for certain processing activities. You may contact HARMAN to request to exercise the rights provided under laws applicable to HARMAN through HARMAN's Data Inquiry and Privacy Request website. HARMAN will respond to such requests as required by law.
Lodging Complaints: In certain jurisdictions, you may have the right to lodge a complaint about our privacy practices with a supervisory authority.
International Transfers of Personal Data
Because HARMAN is a global company with locations all over the world, the locations from which HARMAN collects, processes, and stores your Personal Information may differ from the country where you live. To provide services, your Personal Information may need to be accessed by or transferred to our entities and service providers across the world, including in the United States. HARMAN takes steps to put in place safeguards (such as contractual terms and security protections) to help ensure an adequate level of protection for your Personal Information. Children's Privacy
Our Sites and services are not intended for or directed to persons under 18 years of age. We do not knowingly collect or maintain information from those we know are under 18 except with proper consent. If we become aware that we have collected information from an individual under 18 years of age without proper consent, we will immediately delete such information.
Changes to this Privacy Notice
If we change this Privacy Notice, we will post those changes on this page and update the Privacy Notice “last updated" date above. If we materially change this Privacy Notice in a way that affects how we use or disclose your Personal Information, we will provide a notice of such changes and the effective date of the changes before making them.
